McCloud update

A recent legal case brought by members of the Judicial and Firefighters’ pension schemes found that these schemes were discriminatory to members. This was on the grounds of age discrimination when the career average arrangement was introduced in 2015.

An Employment Tribunal will now decide on the steps needed to compensate members. We’ll keep you informed of decisions they make.

While we await a decision, the Government has confirmed that whatever changes are needed will apply across all the public service schemes, including the Teachers’ Pension Scheme. Furthermore, the Government has confirmed that benefits accrued by members of these schemes will not be reduced as a result of any changes.

Many members may still not be aware of these cases and potential outcomes of the judgement, sometimes referred to as the McCloud judgement.

To help us ensure members have the correct understanding of what is happening, we’ll be creating a factsheet (PDF, 101 KB) (This link opens in a new window), and updating our website with additional information. We’ll keep you update through our bulletin.
