Local Authority maintained schools becoming Academies - Starter and Leaver process

If you’re changing from a Local Authority maintained school to an Academy, we’d like to remind you of some key points to remember:

  1. You need to provide a withdrawn ‘W’ indicator in your last MDC or MCR submission from the Local Authority before moving to an Academy
  2. You’ll then have 40 days to submit new data for your employees under the new Academy
  3. If data is supplied within 40 days, your employees will receive a ‘mover’ pack informing them they’re now under the employment of the Academy.

Please note: If the data isn’t supplied within 40 days, your employees will receive a ‘leaver’ pack, incorrectly informing them they’ve left the Teachers’ Pension Scheme. It’s therefore vital that your first submission under the Academy is received within 40 days of submitting your last as a Local Authority to prevent confusion.

There are additionally a few things you need to inform your employees of when moving:

  • As they’ll now be under a new contract of employment within the Academy, you’ll need to contractually enrol all eligible jobholders into the Scheme when submitting your first MDC or MCR files as an Academy
    • If the Academy provides data via MDC, this will need to be done via the Enrolment Template
    • If the Academy provides data with MCR, this will need to include ‘CONT’ for all eligible jobholders in the ‘Enrolment’ field
  • Any employees who don’t wish to be a part of the Teachers’ Pension Scheme will then need to opt out once contractually enrolled
  • Any members who’ve got elected Faster Accrual flexibilities in place will need to reapply for these within a month of starting in the new contract under the Academy.
