McCloud case – be reassured about your pension

A recent legal case brought by members of the Judicial and Firefighters’ pension schemes found that their schemes were discriminatory to some members. This was on the grounds of age discrimination when the career average arrangement was introduced in 2015.

The Government is considering the next steps to apply the court ruling. What we can confirm is that whatever changes are needed will apply across all public service schemes, including the Teachers’ Pension Scheme.

The final decision on any steps needed to compensate members following the McCloud judgement (as this case is often referred to) is the role of an Employment Tribunal and we’ll keep you informed of any decisions they make.

We want to reassure you that while there will be changes to the Teachers’ Pension Scheme, the Government has confirmed that there will be no reduction to the benefits you have accrued or the pension you’re receiving if you’re a retired member.
